  9. Liability and Disclaimers

At Expat Valley, we are committed to your success. To ensure we can continue providing high-quality support, please note the following boundaries of our responsibility:

    • Our Protective Reach: While we take great care in our work, Expat Valley B.V.—including our subsidiaries, directors, and employees—cannot be held liable for damages arising from the use of our services or products. This includes any indirect losses, such as loss of profit or data, regardless of how they occurred.

    • Your Decisions: Our role is strictly advisory. We provide the tools and guidance, but the final decisions and their outcomes remain the user’s responsibility. We are not liable for errors resulting from incorrect information provided to us.

    • External Factors: We insure all physical products against loss or damage during transit. However, we cannot be held responsible for service delays or omissions caused by events beyond our control, such as strikes, government actions, or natural disasters.

    • Third-Party Services: When we utilize third-party providers to deliver our services, we are not liable for their actions, provided we have exercised due care in selecting them.

    • Liability Limits: In the event we are found liable for direct damages, our total cumulative liability is limited to the fees paid for the specific service in question. In no case will this exceed three times your monthly subscription fee (capped at a maximum of €300).

    • The Legal Standard: These limitations apply to the fullest extent permitted by law. We do not exclude liability for damages resulting from our own wilful misconduct or gross negligence. Should a court rule that any part of this limit is unenforceable, our liability will be strictly capped at the amount covered and paid out by our professional liability insurance.

  10. Jurisdiction and Governing Law
This agreement is governed by the law of the Netherlands. Any disputes will be resolved through amicable negotiations and, if necessary, through mediation as per the rules of the Federation for Mediators in the Netherlands (MfN).
  11. Severability
Should any point in this agreement be found invalid by a court, the rest of our contract stays exactly as it is. We’ll work to replace any ‘broken’ clause with a new, valid one that reflects what we originally agreed upon.
  12. Privacy and Data Protection
Expat Valley B.V. complies with GDPR. Our Privacy Statement, available on our website, outlines our practices regarding data collection, storage, and sharing with third parties.
  13. Modifications to Terms
Expat Valley B.V. reserves the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting on our website.
